Probate - the facts
Probate Doesn’t Have to Be a Nightmare: How We Take the Weight Off Your Shoulders
Losing someone you love is one of the hardest things you’ll ever go through. Your world stops, yet the rest of the world keeps spinning. And sadly, alongside the grief and the memories, there is often a mountain of paperwork waiting for you.
At Secure Wills, we’ve spent years helping families protect their futures through Wills and Trusts. But we know that the story doesn't end there. When a loved one passes away, the legal process of "Probate" begins. For many, this feels like a daunting, confusing, and emotionally draining mountain to climb.
That’s why I am so pleased to announce that Secure Wills is officially launching our new Probate Services.
We’ve seen too many families feel overwhelmed by legal jargon and stressed by hourly solicitors' bills. We wanted to change that. We’re here to take the weight off your shoulders with the same friendly, plain-English, and fixed-fee approach you’ve come to expect from us.
What Exactly is Probate (and why does it sound so scary?)
Let’s start by stripping away the mystery. Probate is simply the legal process of dealing with someone’s assets (their house, money, and possessions) after they have died.
If the person left a Will, the process involves proving that the Will is valid and giving the "Executors" (the people named in the Will) the legal authority to move money and sell property. If there isn't a Will, the process is very similar, but it follows a set of government rules called "Intestacy."
Essentially, Probate is the "key" that unlocks the estate so it can be passed on to the right people.
The reason it feels like a nightmare is usually down to three things:
The Jargon: Words like "Grant of Representation," "Intermeddling," and "Testamentary Capacity" are enough to make anyone’s head spin.
The Responsibility: As an Executor, you are legally responsible for making sure every penny is accounted for and every tax form is perfect. That’s a lot of pressure when you’re still grieving.
The Unknown Costs: Traditional law firms often charge by the hour or take a percentage of the entire estate. This means you never quite know how much of your loved one's legacy will be swallowed up by legal fees.
How We Make It Easier For You
Our goal at Secure Wills is to make this process as smooth as possible. We don’t think you should have to spend your evenings deciphering tax codes or waiting on hold with banks.
Whether you just need a bit of help with the heavy legal lifting or you want us to handle everything from start to finish, we’ve designed our services with you in mind.
1. Grant of Probate Applications
If you’re happy to do the "admin" side of things, like calling the utility companies and distributing the gifts, but you’re stuck on the legal forms for the court and HMRC, this is for you. We will handle the legal application to ensure you get the Grant of Probate quickly and correctly.
2. Full Estate Administration
This is our "hands-off" service. We take care of everything. From valuing the assets and paying off debts to dealing with HMRC and distributing the final inheritance to the beneficiaries. We do the work; you get the peace of mind.
No Jargon, Just Plain English
One of our core values at Secure Wills is communication. We believe that legal services shouldn't be a "black box" where you send off papers and hope for the best.
When you work with us, we promise to speak to you like a human being. We won't hide behind Latin phrases or complicated legal "mumbo-jumbo." We’ll explain what needs to happen, why it needs to happen, and how long it’s likely to take. You deserve to feel informed and empowered, not confused and sidelined.
Fixed Fees: No Hidden Surprises
There is nothing worse than receiving a legal bill that is much higher than you expected, especially during a difficult time.
That’s why we offer fixed-fee pricing for our probate services. Before we start any work, we will give you a clear, transparent quote. That price is what you will pay. No "hidden extras," no "hourly rates," and no "percentage of the estate" surprises.
We believe in being fair. You should know exactly where you stand so you can plan for your family’s future with confidence.
We Come to You: Flexible and Convenient
We know that during a time of loss, the last thing you want to do is commute to a cold, grey office in the city centre and hunt for a parking space.
At Secure Wills, we fit around your life. We offer:
Home Visits: We can come to your house where you feel most comfortable.
Video Calls: If you’d prefer to chat via Zoom or WhatsApp from your sofa, we can do that too.
Evening Appointments: We understand that you have work and family commitments, so we don't just stick to the 9-to-5.
Our job is to make your life easier, not more complicated.
Is Probate Always Necessary?
You might be wondering if you even need to go through this process. Sometimes, if an estate is very small or if everything was held in joint names (like a bank account or a house owned as "joint tenants"), you might be able to avoid formal probate entirely.
However, even "simple" estates can have hidden traps. Banks have different thresholds for when they require a Grant of Probate, some will release £5,000 without it, while others might demand it for anything over £30,000.
If you aren't sure, give us a call. We can look at the situation and give you an honest answer. If you don't need probate, we'll tell you. We’re here to help, not to sell you something you don't need.
Frequently Asked Questions
How long does probate take?
Typically, the process can take anywhere from six months to a year, depending on the complexity of the estate and how busy the Probate Registry is. We work hard to keep things moving as quickly as possible.
What if there is no Will?
Don't worry. We are experts in "Intestacy" rules. We can help identify the correct administrators and ensure the estate is distributed according to the law.
Can I do probate myself?
Technically, yes. But it is a significant legal responsibility. If mistakes are made, especially with Inheritance Tax, the Executor can be held personally liable. Many families choose us to handle it because they want the security of knowing it’s been done right.
What are the costs involved?
Outside of our fixed fee, there are "disbursements" like the government’s probate application fee. We will list all of these out for you at the very beginning so there are no surprises.
